Rental Agreement

Welcome to The Style Archives. This Rental Agreement outlines your rights and responsibilities when hiring garments from our business. Please read it carefully before placing an order. By checking the acceptance box at checkout, you are entering a binding contract.

Rental Agreement

1. Parties & Agreement Overview

·       Identification of Parties: This agreement is between The Style Archives Ltd, a New Zealand-based women’s clothing rental business located in Auckland, trading as "The Style Archives" (the "Owner", “we”, “us” and “our”), and you, the customer (the "Renter", “them”, “you”), whose details are provided at checkout.

·       Description of Service: The Renter agrees to hire women’s clothing items from the Owner for a limited time. Ownership of all garments remains with the Owner at all times.

·       Agreement to Terms: By placing an order and clicking to accept at checkout, you confirm that you are entering a legally binding agreement under the Electronic Transactions Act 2002.

·       Age & Legal Capacity: You must be 18 years or older to enter this agreement. If under 18, guardian consent is required.

·       Consumer Law Compliance: Nothing in this agreement limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. Except as required under New Zealand consumer law, The Style Archives will not be liable for any indirect or consequential loss or damage arising from your rental. This includes no liability for lost opportunities, loss of enjoyment, or any costs beyond the fees you paid us


2. Rental Period & Duration of Hire

·       Fixed Rental Period Options: You can choose a 1 day postal try on, 4, 5, 7, 10, or 14-day rental period at the time of booking. The rental period begins on your scheduled use date (e.g. event date or day before your event) and ends on the agreed return date.

·       Delivery vs. Usage Dates: Garments will typically arrive 1–2 days before your event. However, the rental period starts on the date agreed in your order.

·       Return Deadline: All returns must be dropped at a NZ Post Shop by 3PM on the final day of your rental period. In studio returns will be agreed on a case by case basis.

·       Extensions: Extensions must be requested in advance and are subject to availability and extra charges.

·       Late Returns: Late returns will incur a fee of $25 per day. Items over 10 days late without contact may be treated as lost or stolen.


3. Rental Fees, Payment Terms & Security Authorisation

·       Rental Fee and Inclusions: All rental prices (listed in NZD) include standard dry cleaning. Prices are shown on the website per item. Shipping is charged separately at checkout unless otherwise stated.

·       Upfront Payment: Full payment is required at checkout to confirm a booking. No booking is guaranteed until payment is received.

·       Credit Card Authorisation: At checkout, a zero-dollar Security Authorisation item will automatically be added to your order. By completing your booking, you authorise The Style Archives to hold your card details securely and, if necessary, to charge your card after the rental is completed for any applicable fees, including but not limited to late return fees, damage repair costs, garment replacement costs, or non-return fees, as outlined in this agreement. No additional payment is taken at checkout for this authorisation unless extra charges arise.

·       Pricing Transparency: All charges, including rental, shipping, insurance (if selected), are shown clearly before checkout. All prices include GST where applicable.


4. Booking & Ordering

·       For the best availability, we recommend booking 1–3 weeks in advance of your event. Earlier if you have a rural address.

·       All postal bookings must be placed at least 4 working days before your event to allow for delivery time. Rural customers should book earlier and select rural shipping at checkout.

·       Please set your booking start date as the day before you intend to wear the garment.

·       Local pick-ups may be arranged closer to the event date, subject to stock and appointment availability.


5. Delivery, Shipping and Collection

·       Delivery Method: We use tracked courier services throughout New Zealand. Shipping to rural addresses or for Saturday delivery may incur extra charges.

·       Shipping Timelines: We aim to dispatch items 2–3 days before your rental period.

·       Delays caused by courier services are outside our control.

·       If you booked at least 4 working days before your event, and the parcel does not arrive in time for your scheduled booking:

o   You will receive a store credit valid for 12 months, unless you authorised the courier to leave the parcel without signature or you redirected the parcel.

·       If you booked fewer than 4 working days before your event, and the garment does not arrive on time:

o   No refund or credit will be issued, as the order was placed at your own risk.

·       If you provided a rural delivery address but did not select and pay for rural shipping:

o   No refund or credit will be given if the item does not arrive in time.

·       Responsibility During Transit: Responsibility for the garment transfers to you once it is delivered to your provided address. If you authorise the courier to leave the parcel without signature, you accept full liability. If you redirect parcels once shipped, this can delay delivery by up to 3 working days. No refunds or credits will be issued in such cases.

·       Once a parcel has been marked as delivered, it is the renter’s responsibility to ensure it is received and safely returned. If your parcel is stolen from your property after delivery, you will be liable for the garment's replacement cost.


6. Returns

·       Return Shipping/Drop-off: Return bags and instructions are provided. Lodge/scan your return over the counter at an official NZ Post Shop by 3PM on your due date.

·       Do not use drop boxes or third-party postal agents for returns as this is likely to delay the return process.

·       In store returns will be organised on a case by case basis.

·       Shipping Costs: Return shipping is included in your shipping fee unless otherwise stated. If you lose your return packaging and label, return shipping is at your cost via NZ Post Overnight Courier and email us the tracking number.

·       Lost The Style Archives cotton bags incur a $15 replacement fee.


7. Late Returns & Non-Return Policy

·       Definition of Late: Returns are late if not lodged/scanned at NZ Post by 3PM on your due date or dropped in store at agreed time.

·       Late Fee Structure: A late fee of $25 per day applies for each day the garment is not returned, for up to 10 days past the due date. You will also be charged for any future bookings already confirmed for that item, if we will be unable to fulfil those rentals.

·       Maximum Late Period / Conversion to Loss: If the garment is not returned within 10 days of the due date and we have not heard from you, this will be treated as a non-return. You will be charged 150% of the garment’s original retail price (RRP), and the item will be considered yours to keep. In the event of a non-return, you will also be charged for any future bookings already confirmed for that item, as we will be unable to fulfil those rentals.

·       You are responsible for ensuring the return parcel is lodged over the counter and scanned at an NZ Post location by 3PM on your due date.

·       If you use an unauthorised return method (e.g. street post boxes or untracked services) and delays occur, late fees may still apply.

·       We reserve the right to seek reimbursement for any missed bookings or loss of income resulting from the delay or non-return.

·       No Extensions Without Consent: Keeping an item longer without approval is a breach of contract.


8. Garment Condition & Inspection

·       Condition at Dispatch: All garments are dispatched in clean and wearable condition. They may not be brand new but are of acceptable quality. Every item is carefully maintained. We categorise garments as Flawless, Ready to party, or Timeless, with condition notes so you’ll always know what to expect.

·       Documenting Flaws: Minor flaws will be disclosed on the website listing. Photos are available on request.

·       Inspection on Receipt: Check your garment on arrival. Report any undisclosed damage within 24 hours with photos.

·       Acceptable Wear and Tear: Minor wear (e.g. small pulls, loose threads) is acceptable. Major damage is not.


9. Use of Garment & Care Instructions

·       Permitted Use: Garments may only be used by the Renter for the intended personal event.

·       No Alterations: Do not alter, tailor, pin, or use adhesives on garments.

·       Do Not Clean Garments: Do not attempt to clean the garment – we will take care of that.

·       Proper Care During Wear: Avoid smoke, heavy makeup, fake tan, food and drink spills, and rough activities.

·       No Unlawful Use: Do not lend or sub-rent garments. Items must not be used for unlawful activities.


10. Dry Cleaning, Cleaning and Maintenance

·       Cleaning Included: Professional cleaning is included. Do not attempt to clean garments yourself, as improper cleaning could result in damages for which you will be responsible.

·       Stains and Excessive Cleaning Needs: Extraordinary soiling may incur cleaning or damage fees. Minor wear is expected, but if there’s damage such as rips, fake tan, wine stains, etc., the Renter may be charged for additional cleaning, repair or replacement.

·       Repairs and Maintenance: We handle all repairs. Do not attempt to repair garments yourself. If the garment is returned altered or with signs of altering, you will be charged a restoration or replacement fee.


11. Damage, Loss and Theft

·       Renter’s Responsibility: You are fully responsible for the garment from delivery/pick up until return. The agreement should explicitly state that once a garment is in the customer’s possession, they are fully responsible for it until it is returned. Any damage, loss, or theft of the garment during the rental period is the customer’s liability. If charges are due for damage, loss, or theft, you agree that The Style Archives may process these charges using the Security Authorisation held at the time of booking.

·       Definition of Damage: Damage includes rips, stains, burns, permanent odours, or any misuse including altering such as hemming, pinning, or sewing.

·       Minor Damage and Repair Costs: Minor damages will be assessed fairly, and charges will apply. If your garment is returned with:

o   Light staining (e.g. makeup, tan, food, alcohol)

o   Loose threads or missing buttons

o   Small tears or repairs

·       If you purchased insurance at checkout, these fees may be waived at our discretion. If you did not purchase insurance, the above fees will apply in full.

·       Please do not attempt to wash, dry clean, iron, or alter the garment yourself. If in doubt, contact us first—we’re happy to help.

·       Major Damage or Irreparable Wear: If your garment is returned:

o   With significant damage beyond repair

o   Altered (e.g. hems sewn, straps stitched, safety pins through fabric)

o   In a condition where it cannot be rented again

·       You will be charged 150% RRP and any lost income from cancelled future bookings. Even with insurance, intentional damage or alterations are not covered, and you will still be responsible for full replacement or repair.

·       When you book with us, you’re hiring a piece that’s been loved and cared for—and we ask that you return it in the same spirit. If you're ever unsure how to handle a spill or situation, please get in touch. We're here to help.

 


12. Optional Rental Insurance (See more here) 

·       What’s Covered: If you add insurance to your booking, we will waive or reduce charges (up to $150 value) for:

o   Minor accidental stains (e.g. makeup, drink spills, food marks)

o   Small rips, pulled threads, or minor fabric snags

o   Broken zips, loose buttons or minor hardware issues

o   Damage requiring standard repairs or specialist cleaning

·       What’s Not Covered: Rental insurance does not cover:

o   Total loss or theft of the garment

o   Damage caused by misuse, negligence, or intentional acts (e.g. cutting, burning, unauthorised alterations)

o   Irreparable damage, permanent stains (e.g. red wine, oil, or makeup that can't be removed), or odour damage (e.g. heavy perfume or smoke)

o   Late returns and associated fees

o   Non-returned items

·       Price & Terms:

o   The insurance fee is a small fixed cost added at checkout ($15).

o   Insurance applies per garment per rental and is non-refundable once your booking is confirmed.

o   Insurance must be selected at the time of booking. It cannot be added after dispatch.

·       Notes:

o   Insurance gives peace of mind and covers most minor wear, but it is not a replacement for reasonable care.

o   You must still notify us of any damage upon return so we can assess and repair it appropriately.

o   Customer Indemnity: You agree to indemnify The Style Archives for third-party losses caused by misuse.


13. Cancellations, Refunds & Exchanges

·       Change of Mind or Fit Issues: We do not offer refunds if you change your mind or if the item does not fit as expected.

·       For peace of mind, we recommend booking a try-on or a backup option ahead of your event.

·       Cancellations – Customer Initiated:

o   14+ days before rental start date: Refund to your original payment method minus $5 admin fee.

o   7–13 days before rental: 50% refund or 100% store credit (your choice).

o   Less than 7 days before rental: Store credit only.

o   After garment has been dispatched or worn: No refund or credit is available.

·       Store credits are valid for 12 months from issue.

·       Exchanges – Before Dispatch:

o   If your garment has not yet been dispatched, we’re happy to offer an exchange.

o   You’ll receive store credit (minus a $5 admin fee) to rebook a new style.

·       Exchanges are not available after dispatch.

·       Company Cancellations / Garment Unavailability:

o   If your booked item becomes unavailable due to damage, late return, or other unforeseen issues:

o   You’ll be offered a full refund, or

o   A store credit or alternative style if preferred and available.

·       Dispatch Cut-Off:

o   Once your garment has been sent, the rental is considered in progress. No cancellations, exchanges, or refunds apply after dispatch.


14. Try-On Services (In-Studio and Postal)

·       In-Studio Fitting Appointments: 

o   In-studio try-ons are available by appointment only at our studio in Birkenhead, Auckland.

o   Appointments are 30–45 minutes, and a $20 fee applies. This fee is credited toward your rental if booked within 7 days.

o   Garments must not be worn outside the studio, and all items are tagged for security. Please avoid makeup, fake tan, or perfume that may transfer onto garments.

o   The try-on fee is non-refundable if no rental is made.

·       Postal Try-On: 

o   We offer postal try-ons for selected garments so you can check the fit before committing to a full rental.  Available nationwide for selected garments (non-rural addresses only).

o   Items are for try-on purposes only and must be returned via tracked courier by the stated deadline.

o   All items are sent with security tags - if removed, the full 4-day rental fee will apply. 

o   If you decide to rent one of the dresses you tried on, a $20 credit will be applied toward the future rental of that same dress. This credit is valid for 30 days and can only be used on the same garment.

o   Postal Try-Ons are subject to garment availability and may not be offered during peak periods. We recommend booking at least 2 weeks in advance. If your selected item becomes unavailable (e.g. due to damage or a clash with another rental), we will offer an alternative item, store credit, or refund.

o   Late fees, repair, or full replacement charges may apply if items are returned late or damaged.

o   Liability: By booking a postal try-on, you accept full responsibility for the garment while it is in your care. If it is returned late, damaged, or not at all, you may be charged for repair costs or up to 150% of the garment’s retail value, as per our standard rental terms.


15. Customer Identification and Security

·       ID Verification: First-time renters may be asked to provide photo ID and proof of address.

·       Use of ID Info: ID is used solely for verification and stored securely.

·       Cardholder Authority: The cardholder must authorise the transaction.

·       Fraud Prevention: We reserve the right to cancel bookings if fraud is suspected.


16. Limitation of Liability and Disclaimers

·       Limitation of Business Liability: Our liability is limited to the rental fee paid, except as required by law.

·       No Warranty for Fit or Suitability: We do not guarantee fit. Sizing guidance is provided, but selection is the Renter’s responsibility.

·       Allergies or Sensitivities: We are not responsible for reactions to detergents or materials.

·       Event Outcome: We are not liable for missed events or indirect losses.

·       Third-Party Services: We are not liable for courier delays.

·       Force Majeure: Neither party is liable for failures caused by events beyond their control.

·       We are not responsible for any personal items you leave in pockets of the rented garment or return packaging, and we won’t be liable if they are lost

·       Use of our garments is at your own risk; we are not liable for any personal injury, allergic reaction, or other health issue arising from wearing the rented garment.

·       You agree to indemnify (reimburse) The Style Archives for any losses, damages, or expenses we suffer as a result of your breach of this agreement or misuse of the rental item, including any third-party claims.

·       We reserve the right to refuse future bookings or terminate your access to The Style Archives if you breach our rental terms, including failure to return items, refusal to pay fees, or damage to garments.


17. Privacy and Data Protection

·       Personal Information Collected: We collect your name, contact details, address, payment info, and ID (if required) to process your rental.

·       Use and Disclosure: Data is used only for rental purposes and shared with couriers, payment processors, or debt collectors if needed.

·       Data Security: We take reasonable steps to protect your data.

·       Data Retention: Personal info is retained only as long as necessary for the transaction.

·       Customer Rights: You may request access or correction of your personal data.

·       Marketing Communications: We only send marketing emails if you opt in.


18. General Provisions

·       Governing Law: This agreement is governed by New Zealand law. The parties submit to the non-exclusive jurisdiction of the New Zealand courts,

·       Entire Agreement: This document represents the full agreement between the parties.

·       Severability: If any clause is found invalid, the rest remain enforceable.

·       No Waiver: Failure to enforce any part of this agreement is not a waiver of rights.

·       Amendments: Terms may change. The version agreed at booking applies to that rental.

·       Acceptance & Consent: By clicking “I agree” at checkout, you confirm your understanding and acceptance of these terms.

·       If you do not pay money owed under this agreement, The Style Archives reserves the right to pursue collection, including charging any other payment method you’ve provided, using a debt collection agency, or taking legal action to recover the debt.


19. Acknowledgment and Digital Signature

·       By checking the agreement box at checkout, you acknowledge:

o   You are 18 or older.

o   You understand and accept all terms above.

o   You consent to the addition of a Security Authorisation product to your order and authorise The Style Archives to hold your payment details for the purpose of charging any additional fees incurred under this agreement (such as late return, damage, or non-return fees) after your rental is completed.


20. Dispute Resolution

·       We are committed to providing excellent service and resolving any concerns promptly and fairly. If you have a dispute or complaint about your rental experience, please contact us at info@thestylearchives.co.nz in the first instance so we can work with you to resolve the matter.

·       If we cannot resolve the issue together, either party may refer the matter to the New Zealand Disputes Tribunal, where appropriate. Both parties agree to attempt informal resolution in good faith before escalating to any formal dispute process. Any amounts not in dispute must be paid on time, and disputing a portion of charges is not grounds to withhold other payments.


21. Amendments to This Agreement

·       We may update or amend the terms of this Rental Agreement from time to time. Any changes will be published on our website and will apply to future bookings made after the new terms are published.

·       The terms and conditions that apply to your rental are those in effect at the time your order is placed. We will not make material changes to the terms of an existing rental without your consent.
